THE WOMAN SEAFARERS ARE SAFE?
 


                An unexpected help request from a woman seafarer working as second officer at an well known  approved  Honkong based with 110 years experienced  ship management company having more than 400 ships and 7000 seafarers with lots of awards and accreditation, themselves claims that pioneers of maritime world and seeing seafaring as career not as job, is noticed the difficulties of woman seafarer and lead to  this article
The incident as on her words that she has an professional friction with chief engineer officer on ship, also he always passing sarcastic comments to her which was ignored by her. on a day during bunkering the chief engineer used abusive words on walkie talkie the same aired which heard all crew members on duty, next day afternoon the officer shouted to her in front of  master and duty AB at bridge and followed  a heated argument between both.at the time the master sent down the AB
                Quoted same incident she complained to the master against chief engineer, but as keeping good relation to the chief engineer the master didn’t responded to the complaint, the despised  lady officer complained to her company regarding the incident along with chief officer, third officer and duty seaman’ s signed statements
                The responsible fleet personnel may found difficulties to deal the issue diplomatically or to take action against chief engineer officer they decided to sack easily available second officer rather than take action on precious chief engineer. And company signed off second officer without a notice and  reason and this is reported to her just 12 hrs before the departure. Getting notice the lady contacted to office and requested to not signed off at lome, Togo .the African port which is critical in crime rating, all requests are vain they signed off as they planned and relieved from the anchorage and sent her by a boat. The boat left her at jetty unattended. At  jetty few guys came and started pictures and throwing comments to them at beginning and at last molested her. by god’s grace she escaped from there and reached Mumbai on her office and described to the office what she suffered . the great company officials response was “its quiet normal and it can happen anywhere”.
                Its embarrassing the master and companies irresponsible action as the company and ship following Maritime Labour Convention, and challenging their power above all rules regulation and administration, the stake holders hold on the administration and the relationship  between the company bearers and office bearers of the administration knowing lady officer hesitates to complain this issue to grievance officer and first appellate authority as her passion to the career, if any compliant to the administration she fears her dreams will cremated, will lose jobs from current and other company and also affects her future examination. these are the advice what she got from the industry, and she pointing out whats the favorable action to common seafarer from the administration which her company has stake. all the way the seafarer is suffers
               
                The era we are passing the united nation and its counterpart International maritime organisation, International labour organisation and  all flag state administration are promoting woman’s participation in seafaring and giving special consideration to securing equal access in men and woman in all sectors of shipping. the Busan declaration on 2013is underlined this. the above said incident is require special attention to all administration to be keenly  checked where our woman seafarers are safe, secured and facing any discrimination at their work, taking seriously above incident all the administrations and rule makers to be provide special task and  instructions to the companies and administrations during signing on/off ,work spot they should not be exploited and revenged, attention to be provided and tracked them continuously at their tenure after leaving home and back. it should included one of the responsibility of the company to brought back the woman seafarer safely at her home.

REGISTRATION OF INDIAN SHIP





REGISTRATION OF INDIAN SHIP

For a ship registered in India, the ship is owned by

A citizen of India
A company or a body established or under any central or state act which has its principal place of business in India or
A co-operative society which is registered or deemed to be registered under the co-operative societies act
Company should be registered with mmd and dgs

The owner or agent shall apply for the name approval proposed for the ship to the port of registrar on prescribed format a
A copy of previous certificate of registry  for second hand vessel and a copy of ships details from the builder for a new vessel
A copy of memorandum and article of association of the company
Vessel of 25 years and above need technical clearance
Three names in Hindi and English to be suggested
Along with the application for allotment of name ,official number and call sign combined with the application for allotment of mmsi number will be made by the owner through the registrar to dgs

Carving and marking note
Application for carving and marking note on letter head of the company
Approved tonnage certificate issued by flag or state

Signing of declaration of ownership
Declaration of ownership on prescribed form
To be signed before principal officer/authorised person

Survey of carving and marking on ship
Application of survey of carving and marking onboard ship
Carving and marking survey of vessel will be done by mmd or class surveyor
Certificate of survey,

The registrar shall issue to owner a carving and marking note, which shall be returned to registrar after the carving and marking have been carried out and certified by the surveyor

Permanent or provisional registry
An application to the office of the registrar of indian ships with form as per check list
Declaration of ownership, Original board resolution for a company or signed by all the partners for the partnership firm
Builder’s certificate
Instrument of sale
Original carving & marking duly verified by the surveyor, certificate of survey

A provisional certificate of registry issued to the vessel for six months, if the vessel is abroad or if the documents are not complete as per the requirement

On compleation of preliminaries of registry the registrar shall enter the following particulars
Name of port and where she belongs
The ship identification number
The particular respecting her origin stated in declaration of ownership
The name and description of ships registered owner/owners and the number of shares owned by them

On registry the registrar shall retain following
The surveyors certificate and the builders certificate
Any instrument of sale
All declaration of ownership
Compleation of above, registrar issues certificate of registry containing particulars entered in the register book with name of the master

Issuance of certificate of survey/certificate of registry does not entitle the vessel to ply, unless she has the required statutory certificate and valued document

WRECK REMOVAL CONVENTION

            THE INTERNATIONAL CONVENTION ON THE REMOVAL OF WRECKS WAS ADOPTED AT NAIROBI, KENYA ON 18TH MAY 2007 AND KNOWN AS THE NAIROBI INTERNATIONAL CONVENTION ON THE REMOVAL OF WRECK
            INDIA HAS ACCEDED TO THE CONVENTION ON 23rd MARCH 2011AND THE CONVENTION WILL ENTER IN TO FORCE ON 14th APRIL 2015
            THE CONVENTION IS APPLICABLE TO ALL SHIPS ABOVE 300. GT. INCLUDING FIXED FLOATING PLATFORMS EXCEPT WHEN SUCH PLATFORMS ARE ON LOCATION ENGAGED IN THE EXPLORATION. THE CONVENTION DOES NOT APPLY TO WAR SHIPS AND STATE OWNED OR OPERATED SHIPS
            THE CONVENTION APPLIES ONLY THE EXCLUSIVE ECONOMIC ZONE (EEZ, 12 nm TO 200nm FROM BASE LINE) OF A STATE, HOWEVER STATE CAN SELECT THE APPLICATION OF PROVISION OF THE CONVENTION WITHIN THEIR TERRITORY INCLUDING THEIR TERRITORIAL SEA. (12nm. FROM BASE LINE)
            THE CONVENTION GIVES POWER TO STATE TO TAKE MEASURE TO REMOVE WRECKS LOCATED WITHIN THEIR EEZ THAT POSES A HAZARD TO NAVIGATION OR MAY RESULT IN HARMFUL CONSEQUENCE TO THE MARINE ENVIORONMENT OR DAMAGE TO THE COAST LINE ON OTHER COASTAL INTERESTS SUCH AS FISHERIES AND TOURISAM
            THE CONVENTION DOES NOT APPLY MEASURES TAKEN UNDER THE INTERNATIONAL CONVENTION RELATING TO INTERVENTION ON HIGH SEAS IN CASE OF OIL POLLUTION CASUALITIES 1969
            THE CONVENTION IMPLIES THE COMPULSORY INSURANCE PROVISIONS FOR THE SHIP OWNER OF MORE THAN 300 GT. IS TO MAINTAIN INSURANCE OR OTHER FINANCIAL SECURITY IN A MAXIMUM AMOUNT EQUAL TO THE LIMITS PRESCRIBED BY THE CONVENTION ON LIMITATION OF LIABILITY FOR MARITIME CLAIMS, THE FLAG STATE WILL ISSUE CERTIFICATE OF INSURANCE OR OTHER FINANCIAL SECURITY IN RESPECT OF LIABILITY FOR THE REMOVAL OF WRECKS (CIOFS). THE CERTIFICATE ENSURES THAT SUFFICIENT INSURANCE IS IN PLACE IN COMPLIANCE WITH CONVENTION.

WRECK
            WRECK MEANS
A SUNKEN OR STRANDED SHIP OR
ANY PART OF A SUNKEN OR STRANDED SHIP INCLUDING ANY OBJECT THAT IS OR HAS BEEN ONBOARD SUCH SHIP OR
ANY OBJECT THAT IS LOST AT SEA FROM A SHIP AND THAT IS STRANDED,SUNKEN OR ADRIFT AT SEA OR
A SHIP THAT IS ABOUT OR MAY REASONABLY BE EXPECTED TO SINK OR TO STRAND, WHERE EFFECTIVE MEASURES TO ASSIST THE SHIP OR ANY PROPERTY IN DANGER ARE NOT ALREADY BEING TAKEN

REPORTING WRECKS
            THE MASTER AND OPERATOR OF A SHIP FLYING ITS FLAGS TO REPORT TO THE AFFECTED STATE WITHOUT DELAY WHEN THAT SHIP HAS BEEN INVOLVED IN A MARITIME CASUALITY RESULTING A WRECK
            SUCH REPORT SHALL PROVIDE THE NAME AND THE PRINCIPAL PLACE OF BUSINESS OF THE REGISTERED OWNER AND ALL THE RELEVANT INFORMATION NECESSARY FOR THE AFFECTED STATE TO DETERMINE WHETHER THE WRECK POSES A HAZARD
1.PRECISE LOCATION OF THE WRECK
2.THE TYPE,SIZE AND CONSTRUCTION OF THE WRECK
3.THE NATURE OF THE DAMAGE TO, AND CONDITION OF THE WRECK
4.THE NATURE AND THE QUANTITY OF THE CARGO, IN PARTICULAR ANY HAZARDOUS AND NOXIOUS SUBSTANCES AND
5.THE AMOUNT AND TYPES OF OIL, INCLUDING BUNKER OIL AND LUBRICATING OIL ONBOARD

DETERMINATION OF HAZARD
THE TYPE SIZE AND CONSTRUCTION OF WRECK,DEPTH OF THE WATER IN THE AREA,TIDAL RANGE AND CURRENTS IN THE AREA PARTICULARLY SENSITIVE SEA AREA IDENTIFIED, PROXIMITY OF SHIPPING ROUTES OR TRAFFIC,TRAFFIC DENSITY AND FREQUENCY AND TYPE OF TRAFFIC ETC ARE HAZARD DETERMINING SPECIFICATIONS

LOCATING WRECKS
            AFTER AWARE OF A WRECK, THE AFFECTED STATE SHOULD WARN MARINERS USING ALL PRACTICABLE MEANS STATE SHALL ENSURE THAT ALL PRACTICABLE STEPS ARE TAKEN TO ESTABLISH THE PRECISE LOCATION OF THE WRECK

MARKING OF WRECK
            AFFECTED STATE SHALL ENSURE THAT ALL REASONABLE STEPS ARE TAKEN TO MARK THE WRECK AND CONFIRM INTERNATIONALLY ACCEPTED SYSTEM OF BUOYAGE IN USE AND INCLUDE IN NAUTICAL PUBLICATIONS

MEASURES TO FACILITATE TO WRECKS

            IF AFFECTED STATE DETERMINES THE WRECK A HAZARD, THE STATE SHALL IMMEADIATLY INFORM STATE OF SHIPS REGISTRY AND REGISTERED OWNER. PROCEED TO CONSULT THE STATE OF THE SHIPS REGISTRY AND OTHER STATES AFFECTED BY THE WRECK REGARDING MEASURE TO BE TAKE IN RELATION TO THE WRECK
            THE REGISTERED OWNER SHALL REMOVE THE WRECK DETERMINED A HAZARD. THE REGISTERED OWNER OR OTHER INTERESTED PARTY SHALL PROVIDE COMPETENT AUTHORITY OF THE AFFECTED STATE WITH EVIDENCE OF INSURANCE OR OTHER FINANCIAL SECURITY
            THE REGISTERED OWNER MAY CONTRACT WITH ANY SALVOR OR OTHER PERSON REMOVE WRECK ON BEHALF OF OWNER WITH THE CONDITIONS AFFECTED STATE TO ENSURE THAT SAFETY AND PROTECTION OF THE MARINE ENVIORONMENT
            IF THE OWNER DOES NOT REMOVE THE WRECK WITHIN THE DEADLINE OR OWNER NOT CONTACTED IT, AFFECTED STATE MAY REMOVE THE WRECK UNDER REGISTERED OWNERS EXPENSE

      CARGO SHIP SAFETY EQUIPMENT CERTIFICATE SHALL BE ISSUED AFTER SURVEY TO A CARGO SHIP OF 500 GT. AND OVER WHICH COMPLIES WITH THE RELEVANT REQUIREMENTS OF CHAPTER II-1,II-2.AND III AND ANY OTHER RELEVANT REQUIREMENT SOLAS-74
       A RECORD EQUIPMENT FOR THE CARGO SHIP SAFETY EQUIPMENT CERTIFICATE (FORM-E) SHALL BE PERMANENTLY ATTACHED. IT CONTAINS THE ADDITION OF EQUIPMENT CARRY FOR SAFE LIFE ONBOARD, INCLUDING LIFE SAVING APPLIANCES, FIRE FIGHTING APPLIANCES AND LIGHT AND SOUND SIGNALS

5.ANNUAL SURVEY

CARGO SHIP SAFETY CERTIFICATE
     IT DEALS WITH BOTH SAFETY EQUIPMENT, SAFETY CONSTRUCTION AND SAFETY RADIO EQUIPMENT COMBINED ISSUED FOR BELOW 500.GT VESSEL. CERTIFICATE VALID TO 5 YEARS ANNUAL AND INTERMEDIATE SURVEY TO BE CARRIED OUT
